Terms of Service
Effective June 4, 2026
These Terms of Service (“Terms”) govern your use of hostanyway.com and the calculators, printables, emails, events, and other services offered there (the “Service”). By using the Service, you agree to these Terms.
1. Who we are
The Service is operated by InSync Solutions LLC, a Wyoming limited liability company, doing business as Host Anyway. Reach us at hello@hostanyway.com.
2. Use of the Service
You may use the Service for personal, non-commercial purposes only. You agree not to:
- Scrape, crawl, or copy the Service in bulk
- Reverse engineer or attempt to extract source code
- Use automated tools to submit forms or generate calculator output
- Resell, sublicense, or redistribute our calculators, printables, or content
- Collect, download, export, or scrape other people’s information from the Service (including guests’ event responses) for marketing, advertising, or any purpose other than running your own event
- Contact event guests off the Service for purposes they did not agree to
- Misrepresent your identity or use the Service to harass others
- Interfere with the Service’s operation, security, or other users
3. Hosting an event
When you create an event and share its link, you are the host. You decide what to ask your guests and how your event runs — so for the information your guests submit, you are the controller of that information and Host Anyway is your service provider, storing and organizing it on your behalf and only as these Terms and our Privacy Policy allow.
As a host, you agree that:
- You are at least 18 years old and able to enter these Terms.
- You will collect and use your guests’ information lawfully and fairly, only to plan and run your event, and you are responsible for how you use what your guests share with you.
- You will not collect health, medical, or other sensitive information through the Service. Our forms deliberately steer allergy and dietary-safety questions to direct contact with you, and you remain responsible for your guests’ food safety (see Section 6).
- You will not use guests’ information to send them marketing, to contact them off the Service for unrelated purposes, or to sell or share it.
- You understand that when a guest claims a potluck item, that guest’s first name is shown to your event’s other guests so the same item isn’t brought twice; no other guest information is shown to other guests.
- If you enter a headcount or names that include children, you are responsible for that information; the Service never invites children to submit their own information.
You are responsible for the content of your event (its name, description, and details), and for making sure your guests understand that you — not Host Anyway — are the one collecting their responses.
4. Responding as a guest
You can respond to an event without an account or a password. The edit link in your confirmation is your private key to view, change, or delete your own response from any device — keep it to yourself. Please respond only for yourself and the people in your own party, and don’t submit anyone’s health or medical information; if you have a food allergy, tell the host directly. A genuine Host Anyway link never asks you for an email password or a login to view an invitation — if something does, it isn’t us. If you are under 16, please ask a parent or guardian to respond for you.
5. How we handle event data
For the guest information collected through an event, Host Anyway acts only as a service provider (processor) to the host. We:
- process that information only to provide the Service (as these Terms and our Privacy Policy describe), and on the host’s reasonable instructions;
- do not sell or share it, and do not use it for our own advertising, profiling, or marketing;
- use the sub-processors listed in our Privacy Policy (hosting, storage, email, bot protection, rate limiting, error monitoring) under contracts requiring them to protect it; and
- delete it on the schedule in our Privacy Policy (events and their responses auto-delete about 7 days after the event), and will help a host delete an event, or a guest delete their own response, on request.
This Section describes how the Service actually works; it is not a negotiated data-processing agreement. If you need a formal data-processing agreement, contact us.
6. Calculator output is informational
Our calculators provide quantity estimates, shopping suggestions, and printable summaries based on your inputs. They are informational, not professional advice. Your results may vary based on your guests, their dietary needs, what’s available locally, and your own taste. We are not responsible for under- or over-buying, allergic reactions, or any cost incurred from following our suggestions.
You are responsible for confirming dietary, allergy, and food safety information with your guests directly.
7. Newsletter and email
When you sign up, we send you a confirmation email (double opt-in). After confirmation, you receive periodic emails with calculator updates, hosting tips, and occasional promotions. Every email contains a one-click unsubscribe link. Unsubscribing immediately stops new marketing email; we may still send transactional email related to a purchase or request.
Separately, when you host or respond to an event, we may send event-related email — a confirmation with your edit link, or reminders a host turns on. These are transactional messages about your event, contain only event content (no Host Anyway promotions), and stop when the event ends or is deleted.
8. Affiliate links
Many outbound links from the Service are affiliate links. If you click and purchase, we may earn a small commission at no extra cost to you. We disclose this in a dedicated Affiliate Disclosure and where required on individual links.
9. Intellectual property
The Service, calculators, printables, brand name, logo, and content are owned by InSync Solutions LLC and protected by copyright, trademark, and other applicable laws. We grant you a personal, non-exclusive, non-transferable license to use the Service. We reserve all other rights.
10. User-submitted content
If you send us feedback, suggestions, or other content (by email or any other channel), you grant us a non-exclusive, royalty-free, perpetual license to use that content to operate and improve the Service. We won’t share your name or email publicly without consent. Content you put into an event (its details and the responses guests submit) is handled as described in Sections 3–5 and in our Privacy Policy, not under this license.
11. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of liability
To the fullest extent permitted by law, InSync Solutions LLC, its members, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service. Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months preceding the claim, or USD $100 if you paid us nothing.
13. Indemnification
You agree to defend and indemnify InSync Solutions LLC against any claim arising from your misuse of the Service, your breach of these Terms, or your violation of any third-party right — including any claim arising from an event you host or the information you collect from or about your guests, and any claim that your content violates a third party’s privacy or publicity rights.
14. Termination
We may suspend or terminate your access to the Service at any time, for any reason, including suspected abuse. If we end a host’s access for a reason other than abuse or a legal requirement, we will, where practical, give the host a short window to download their event data before it is deleted. You may stop using the Service at any time. Termination does not affect any provision that, by its nature, should survive (intellectual property, disclaimers, limitation of liability, indemnification, governing law).
15. Governing law
These Terms are governed by the laws of the State of Wyoming, without regard to conflict- of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in Natrona County, Wyoming, and you consent to that venue. Where required by your local consumer-protection law, this clause does not override your statutory rights.
16. Changes to these Terms
We will post changes here with a new effective date. Material changes that adversely affect you will be communicated by email if you’ve given us your email (for example, a newsletter signup or a host account), with at least 14 days’ notice. Your continued use after the effective date constitutes acceptance.
17. General
If any provision of these Terms is found unenforceable, the rest stay in effect. These Terms (with the Privacy Policy and any page they reference) are the entire agreement between you and us about the Service. Our not enforcing a provision isn’t a waiver of it. You may not assign these Terms; we may assign them to an affiliate or to a successor in connection with a merger, acquisition, or sale of assets.
